1Acceptance of These Terms

These Terms of Service (Terms) govern your access to and use of the Autism360 platform, including our website, mobile and web applications, content and related services (together, the Services), operated by Datta Corp Pty Ltd ABN 84 625 581 848 (Autism360, we, us or our).

By creating an account, or by accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

2About Autism360

Autism360 is an at-home autism therapy platform that helps parents and carers lead daily progress with their child through programs, workshops, sessions, tasks and AI-supported guidance. In these Terms, Autism360 may also be referred to as ‘Autism 360’, ‘A360’ or ‘AutisMag’.

3Eligibility and Parental Responsibility

You must be at least 18 years old and able to form a legally binding contract to use the Services. Where the Services are used in relation to a child or NDIS participant, you confirm that you are that person’s parent, guardian or authorised representative and that you have the authority to provide information and consent on their behalf.

4Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information, keep it up to date, and notify us promptly at support@autism360.com if you become aware of any unauthorised use or security incident.

5Subscriptions, Fees and Payments

Some features are offered on a paid subscription basis. By subscribing, you authorise us, or our third-party payment providers, to charge the applicable fees.

  • (a)fees, billing cycles and inclusions are shown to you at the point of purchase;
  • (b)subscriptions may renew automatically unless cancelled before the renewal date;
  • (c)except where required by law (including the Australian Consumer Law), fees are non-refundable;
  • (d)we may change fees or plan inclusions on reasonable notice.

6Acceptable Use

When using the Services, you agree that you will not:

  • (a)use the Services for any unlawful, harmful or fraudulent purpose;
  • (b)upload or share content that is unlawful, infringing, abusive or harmful;
  • (c)attempt to gain unauthorised access to the Services or related systems;
  • (d)copy, scrape, reverse engineer or interfere with the platform or its security; or
  • (e)use the Services in any way that could harm Autism360, other users or any child.

7AI-Supported Features

The Services include AI-supported features, including the VARA assistant, which help organise information, highlight patterns and provide supportive guidance. AI-generated outputs, insights and summaries are provided for informational purposes only, may be inaccurate or incomplete, and may change over time as our systems improve.

AI outputs do not constitute medical, clinical, therapeutic, psychological, legal or professional advice, and you remain responsible for how you use them.

8Medical and Clinical Disclaimer

Autism360 provides supportive tools and information. It is not a substitute for advice from an appropriately qualified professional and does not provide medical, clinical or psychological services through the platform. Responsibility for decisions relating to a child’s care, treatment, wellbeing or supports remains with the parent, guardian or authorised decision-maker. In an emergency, contact your local emergency services immediately.

9Intellectual Property

All content, software, designs, trademarks and materials forming part of the Services are owned by or licensed to Autism360 and are protected by law. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Services for your personal, non-commercial use in accordance with these Terms.

10Trademarks

‘Autism 360’, ‘Autism360’, ‘A360’, ‘AutisMag’, the Autism360 logo, and related names, marks, slogans and branding (together, the Marks) are trademarks of Datta Corp Pty Ltd. The Marks are protected as registered and/or common law trademarks in Australia, the United States, the United Kingdom and India, and may be protected in other jurisdictions.

You must not use, copy, imitate, modify, register or incorporate any of the Marks (or any confusingly similar name or mark) in any business name, trading name, domain name, product, service, application, social media account, advertising or other material without our prior written permission. All goodwill arising from use of the Marks accrues to Autism360, and we reserve the right to enforce and protect our rights in the Marks to the fullest extent permitted by law.

11Copyright

All content made available through the Services and our official channels — including text, documents, programs, workshops, session materials, software, source code, designs, graphics, illustrations, photographs, audio, video, AI-generated outputs, and the selection, structure and arrangement of that material (together, the Content) — is owned by or licensed to Autism360 and is protected by copyright and other intellectual property laws in Australia and around the world.

This applies to Content on our website, the Autism360 mobile and web applications, the client portal, and our official social media channels. Except as expressly permitted by these Terms or by applicable law, you must not copy, reproduce, download, scrape, republish, distribute, broadcast, adapt, modify, translate, publicly display, sell, licence or create derivative works from any Content without our prior written consent.

12Your Content

You retain ownership of the information and content you submit to the Services. You grant Autism360 a licence to host, store, process and use your content to operate, provide, secure and improve the Services and to generate insights, as described in our Privacy Policy. You are responsible for ensuring you have the rights and consents needed to share any content, including information about a child or another person.

13Third-Party Services and Links

The Services may integrate with, or contain links to, third-party products, websites and services. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies. We encourage you to review them before use.

14Social Media Channels

Autism360 operates official social media channels and online communities. Content we publish on those channels remains subject to the Trademark and Copyright provisions of these Terms, and each channel is also governed by the terms and policies of the platform on which it operates.

When engaging with our social media channels or communities, you agree that you will not:

  • (a)post unlawful, misleading, harmful, abusive, defamatory or infringing content;
  • (b)share another person’s personal or sensitive information, including information about a child, without their consent;
  • (c)impersonate Autism360 or any other person, or misuse our Marks or Content; or
  • (d)post spam or advertising, or otherwise interfere with the community or its members.

We may moderate, hide or remove content and restrict participation at our discretion. Any content you submit to our channels may be used by us in accordance with these Terms and our Privacy Policy, and with the applicable platform’s terms. Communications through social media are not a substitute for contacting our support team and are not appropriate for urgent, professional or emergency assistance.

15Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, store and disclose your personal information (including sensitive information) and forms part of these Terms. If you use our mobile or portal experience, the App Privacy Policy also applies. Please read both carefully.

16Service Availability and Changes

We aim to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free access. We may add, modify, suspend or remove features, or perform maintenance, at any time.

17Suspension and Termination

We may suspend or terminate your access to the Services if you breach these Terms, or where reasonably necessary to protect the Services, other users or any child. You may stop using the Services and close your account at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) will continue to apply.

18Disclaimers

To the extent permitted by law, the Services are provided on an ‘as is’ and ‘as available’ basis without warranties of any kind, whether express or implied. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

19Limitation of Liability

To the maximum extent permitted by law, Autism360 and Datta Corp Pty Ltd will not be liable for any indirect, incidental, special or consequential loss, or loss of data, profits or goodwill, arising from your use of the Services. Where our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid for the Services in the 12 months before the relevant claim or, at our option and where permitted, the resupply of the Services.

20Indemnity

To the extent permitted by law, you agree to indemnify Autism360 and Datta Corp Pty Ltd against claims, liabilities, losses and reasonable costs arising from your misuse of the Services, your content, or your breach of these Terms.

21Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

22Changes to These Terms

We may update these Terms from time to time. We will post the updated version and, where appropriate, notify you via the Application, internal portal or other reasonable means. Your continued use of the Services after an update means you accept the revised Terms.
